Trust Fund

Why set up a trust fund?

A trust fund is a collection of assets set aside from the settlor's ownership, designated for specific aims and purposes and managed by a selected person (trustee) for the benefit of the beneficiary (settlor). These assets set aside in the trust no longer belong to the founder and are converted into managed assets without an owner. The trust has no legal personality and no legal personality.

A trust fund is a tool that can reduce the disadvantages of asset ownership, such as administration, loss of privacy, business or investment risk or the preparation of assets for future generations. The trust separates and protects the assets and allows the beneficiaries to enjoy their fruits.

Examples of the use of a trust

  • Benefit to another person - use for the benefit of a particular person or persons to whom the trust is to be paid.
  • Inheritance - clearly defined terms will ensure that the settlor has full control over the transfer of the assets so set aside to future generations (can be created both during life and on death).
  • Investments - a trust can also be set up for investment purposes. In the event of failure, the settlor need not then fear that creditors will seek to seize the settlor's remaining assets.
  • Administration - the owner of a company or several companies who no longer wants to deal with its operation can place it in a trust where it will be administered by an elected trustee.
  • Public benefit - incorporation for a charitable purpose.
